Terms And Conditions

Order Acknowledgment
Acknowledgments are sent e-mail.  It will be sent following receipt of your purchase order with the intent of communicating the receipt of your order and prices.  The acknowledgment must be examined and signed so that any misunderstanding can be resolved prior to production.  Your order will be produced as displayed on your signed sales order acknowledgment.


Ship Date
The ship date for any order will be established upon approval of artwork.  Delivery quoted in “days” is business days after approval of artwork excluding recognized holidays.


Artwork
We size all artwork to the artists’ discretion for each particular ware, unless otherwise specified in writing.  To assure proper processing of your order, artwork must have complete and specific instructions as to layout, size, typestyle and placement.  All electronic art should be accompanied by a “hard copy” of the art with the purchase order.  The prices in this catalog reflect being supplied with camera ready art.  We realize distributors may not always have camera ready art.  We have artwork services available at $57.50 (g) per hour.  You will be advised in advance for order processing of any extra artwork charges and an approval will be required prior to processing the order.  We reserve the right to determine what is acceptable and ready artwork.  Typestyle will be matched as close as possible.  Up to four lines will be provided at no additional charge.  All direct screen print items will incur a charge of $47.50 (g) per color at the time of the original order.  Set Up charges are waived when a repeat order with the exact same art on the exact same ware is placed within 24 months of the original order. 


Artwork Placement
For Handled ware, screen imprinting begins and ends 1” from the handle on both sides.  If you require a tighter print or wraparound, a decal or sublimation process may be available.  For handled items, you must specify the area that you want the design placed as either: Side 1, Side 2, both sides or wrap.  Any order for handled items without a location specified will be imprinted on Side 1 only.  For imprinting on non-handled items, the imprinting of multiple colors may require the use of a decal.


Color Changes
Should you require part of the order to be imprinted in a different color within a production run using the same screen, there is a color change charge of $18.75 (g) for each color change.  


Complaints
Complaints must be made within 30 days after the receipt and must be submitted in writing.  When a freight carrier is involved, refer to Freight Claims Section.  We reserve the right to inspect items from the actual production run before resolving any disputes.


Art Changes
Any changes to art after submission is made for approval will incur a $31.25 (g) per color charge for each time the art/virtual copy is changed.  If changes are made after screens are created, additional screen charges of $47.50 (g) per color will apply.


Creating Artwork
We have a highly technical and skilled graphics art department.  We offer creative services at a charge of $56.25 (g) per hour.


Pre-Production Samples
A pre-production sample can be supplied at $40.00 (g) per color, plus normal art and screen charges.  Screen charges from the approved pre-production samples will be credited towards the actual order.  Baltimore Glassware Decorators reserves the right to require approval of a pre-production sample for your approval prior to production.  Waiving approval of the pre-production sample to expedite quicker delivery will also waive all rights to any claims.  Normal art and screen charges are still applicable.  Any revisions or changes to your original instructions for any pre-production sample will incur additional art, screen, and sampling charges, and will revise your scheduled ship date.  These charges are non-refundable.  


Post Production Samples
A sample from the production run is available when the quantity of the production run exceeds the original order amount.  Please request “sample to distributor” on the purchase order and add $6.25 (g) plus cost of item and shipping charges.


Rush Orders
We offer very aggressive rush services on all items.  Orders requiring completion within 10 business days must be quoted.  Services and charges applied will be based on artwork, item, and availability.


Freight Charges & Shipping
Orders are shipped immediately upon completion unless otherwise requested.  Shipments are sent FOB our shipping dock, freight prepaid unless otherwise requested.  To ensure safer delivery for shipments via non LTL a master carton is necessary to provide consolidation and protection.  There is a charge of $11.88 (g) per carton and includes additional handling and labeling.  Master carton charges are in addition to standard shipping fees from shipping company used.  We ship orders by the method we determine as “Best Way”.  Please note that if “Best Way” is indicted on the purchase order, BGD is given authority to determine “Best Way”.  “Best Way” does not necessarily mean least expensive.  “Best Way” is defined as the method to get your order to you on time and intact.  If you desire an economical method, pease indicate a specific carrier for your particular order.  Choosing your own carrier will hold BGD harmless from any freight claims.  All special shipping requirements ( not limited to but potentially including inside delivery, lift gate, sort and segregate ) must be requested and arranged prior to shipping/invoicing.  BGD reserves the right to alter freight billings from within 30 days after the original invoice is sent, due to delayed invoicing from the carriers as a result of miscellaneous charges incurred for brokerage fees, freight surcharges, inside delivery charges or other charge backs. A $18.75 (g) service and handling charge is applied for all third party shipments.  If you request a third party billing for freight, please add $15.00 (g) per pallet charge in addition to all standard freight charges.


Drop Shipping
There is a $10.00 (g) charge for each drop, split, or release shipment after the first shipment.  Any orders in less than full cases will require a specific quotation and may result in an up charge.


Inside Delivery
Inside delivery will incur additional delivery charges.  If an inside delivery is requested at the time the carrier arrives, be advised you will receive an additional subsequent invoice for this service in addition to your original invoice.  If you require an inside delivery, you must specify inside delivery and the suite/room number on the purchase order.  Any delivery beyond a loading dock may be considered an inside delivery.  Deliveries beyond the buyers loading dock are subject to additional charges and will only be done at the customer’s risk.


Freight Claims
Title to the goods passes to the buyer at the FOB point or upon mailing of the invoices for finished work, whichever occurs first.  Individual package carrier claims should be reported to BGD within 10 days from receipt of the shipment.  You must retain possession of the goods relating to the claim, as all carriers reserve the right of inspection.  Please ensure that yousign for the correct carton count.  The minimum order to replace breakage is 36 pieces.  Choosing your own carrier will hold BGD harmless from any breakage or freight claims.  All goods shipped via common carrier are shipped at the buyers risk and all claims must be made against the carrier.  Recourse rests exclusively with the transportation company.  Claims must be filed with the carrier within 15 days from receipt of the shipment.


Invoicing & Payments
Invoicing is completed immediately upon completion of your order at our facility.  Invoicing is not impacted by special arrangements or requests for alternate shipping dates.  Payments are due accordingly to terms.  A late fee of 18& per annum is accessed when terms are exceeded.  All special pricing is null and void on any order when terms are exceeded on a per-order basis.  In such cases, regular column pricing will apply.  BGD reserves the right to require a down payment or payment in whole on any order.  BGD reserves the right to require payment in full on any order prior to release from our facility.  When down payments are made by credit card, BGD will process the remaining amount due, upon completion, utilizing the same card unless instructed otherwise.  BGD  reserves the right to retain the services of a collection agency and/or attorney to collect past due payments and debts.  In such cases, the customer bearsthe full cost of such services.


Hold Orders
Orders may be held for shipment at a later date.  The entire order will be produced and invoiced upon order completion.  The distributor owned merchandise will be held in our warehouse until releases are requested.  The full order must be released within 6 months.  A full release schedule submitted with the initial orders will not suffice.  All customer’s property stored at BGD is stored at the customer’s risk.  BGD is not liable for any loss or damage caused thereto.  Each release shipment will incur a $10.00 (g) charge.


Order Cancellation
Charges incurred prior to cancellation of an order will be invoiced.  Minimum charge of $40.00 (g).  Any order aged beyond 48 hours will incur the full invoicing of the order.


Prices
Prices are based upon material and labor costs as of the date of the catalog or price sheet printing.  Every effort is made to verify accuracy of this catalog and maintain pricing.  However, BGD reserves the right to change pricing without notice.


Proofs
BGD provides one proof at no charge for a pending or current order.  If revisions are to be made and an additional proof is required, an additional cost of $31.25 (g) per color will apply.  As a result of settings of most monitors ( varied calibrations, color management, varying degrees of brightness and resolution ), the actual imprint color(s) and imprint location will vary with actual production run.  Be aware that most virtual samples are a visual guide and may not reflect the exact imprint placement for the actual production run.  The form sent must be signed as approved and returned before production of your order begins.  We require a signed proof for each new piece of artwork.  We reserve the right to require the approval of a pre-production sample for large and or complicated artwork and orders requiring the use of the decal process.


Quality Of Ware
Slight variations and tiny imperfections in glassware and ceramics are not considered flaws.  There are almost always slight differences in diameter, height, and other dimensions in glassware and ceramics.  Listed ounces and weights will vary.  Fluid capacities are approximate and should not be used as a standard of measure.  Our capacity specifications allow for a tolerance of plus or minus 5%.  Due to the individual craftsmanship of the hand dipped and lined duo-toned mugs collection, variances do occur in the color portions of the glaze.  Variations in materials, firing temperatures, and glazes may result in dissimilarities in glassware and ceramics.  These conditions are within acceptable industry standards.  The nature of the individual and painted glazes does not allow for credit adjustments for line width variances, varying color shades as a result f the hand painted process.  


Quantity Shipped/Quantity Ordered
Due to the difficulty of manufacturing exact requirements without sacrificing quality, all shipments of 288 pieces or less are subject to 10% over or under the quantity ordered and must be considered fulfillment of the order.  Orders for 289 pieces or more are subject to 5% over or under the quantity ordered.  Orders requiring no overruns are subject to an under run of up to 10%.  Exact quantity shipments are available for an additional charge of $25.00 (g).


Registration Of Multiple Colors
Where it becomes necessary to register one color or more next to another, there is the possibility of misregistration of approximately 1/16” depending on the size and shape of the ware being decorated.  This tolerance meets industry standards, and is considered acceptable.


Trademarks
You must own the intellectual property rights to the artwork or copy submitted for imprint or by way of assignment are authorized to submit the art or copy.  By submitting artwork or copy, you and your client agree that you are in compliance with all laws related to trademark, copyright, and all other intellectual property rights in the artwork or copy submitted.  BGD disclaims all liability for non-compliance with these laws.  By submitting any artwork or copy, you agree to hold harmless BGD from all liability for alleged copy write or trademark violations including all costs associated with defending any legal claims.
